TERMS & CONDITIONS

By using our services or placing an order with Gatsby Printworks, you agree to comply with and be bound by the following terms and conditions.

1. Acceptance of Terms

By accessing our website, requesting a quote, approving artwork, submitting payment, or placing an order, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our website or services.

2. Services Provided

Gatsby Printworks provides custom screen printing, embroidery, direct-to-garment printing, direct-to-film printing, artwork, and related apparel-decoration services. We reserve the right to reject any project or design that is inappropriate, unlawful, unsafe to produce, or believed to infringe upon intellectual property rights.

4. Payment Terms

Full payment is required before production begins unless alternative terms have been approved by Gatsby Printworks in writing. Production is not scheduled until payment is received and all required artwork approvals are complete.

5. Turnaround Time

Turnaround time begins only after full payment has been received, artwork has been approved, and all required order information has been provided.

Turnaround times are estimates rather than guaranteed completion dates unless a specific deadline has been accepted by Gatsby Printworks in writing. Turnaround may be affected by garment availability, customer-requested changes, proofing delays, equipment issues, weather, holidays, shipping-carrier delays, supply-chain interruptions, or other circumstances outside our reasonable control.

6. Production Quantities and 5% Over/Under Runs

Due to the nature of custom apparel production, final quantities may vary by up to 5% over or under the quantity ordered. Customers will be invoiced or refunded based on the actual quantity produced and shipped.

Exact quantities must be requested and accepted in writing before production begins. Exact-quantity orders may require additional garments and may be subject to additional charges.

7. Color and Production Variance

Gatsby Printworks makes reasonable efforts to reproduce approved artwork and requested colors accurately. However, minor variations are inherent in custom apparel production and are not considered defects.

Color and appearance may vary because of:

Pantone references and physical samples are used as targets, but an exact match cannot be guaranteed on every garment or production method. Reasonable variations in color, placement, registration, print texture, garment measurements, and embroidery appearance are considered acceptable production tolerances.

8. Order Inspection and Claims

Customers must inspect and count all items promptly upon receipt. Any claim involving shortages, incorrect items, visible defects, damage, or production errors must be submitted to Gatsby Printworks within 5 business days of delivery.

Claims should include the invoice or order number, affected quantity, garment size and color, a clear description of the issue, and photographs when applicable. Gatsby Printworks may request that affected products be returned or made available for inspection before approving a remedy.

Claims submitted after the 5-business-day inspection period may be denied. Normal color, placement, registration, sizing, garment, and production variations are not considered defects.

9. Returns, Refunds, and Remedies

Because all decorated products are made specifically for the customer, all sales are final. Returns, refunds, replacements, or credits are available only for approved claims involving a verified manufacturing defect or an error caused by Gatsby Printworks.

For an approved claim, Gatsby Printworks may, at its discretion, repair the affected products, replace them, issue an account credit, or refund the amount paid for the affected items. Gatsby Printworks is not responsible for replacing an entire order when only a portion of the order is affected.

10. Customer-Supplied Garments and Items

Customer-supplied items are accepted only with prior approval. Decoration involves heat, pressure, ink, needles, machinery, and other processes that may occasionally damage an item. Unless otherwise agreed in writing, customer-supplied goods are provided at the customer's risk, and Gatsby Printworks is not responsible for replacement costs beyond the decoration charge.

11. Intellectual Property

Customers retain ownership of their submitted designs. By providing artwork or other materials, the customer grants Gatsby Printworks a non-exclusive license to reproduce, resize, separate, modify, and otherwise use those materials solely as reasonably necessary to quote, proof, produce, and fulfill the order.

12. Limitation of Liability

Gatsby Printworks is not responsible for:

To the fullest extent permitted by law, Gatsby Printworks' total liability is limited to the amount paid for the affected products or services.

13. Changes to Terms

Gatsby Printworks may update these Terms and Conditions from time to time. Changes will be posted on this page. The terms in effect when an order is placed will govern that order unless otherwise agreed in writing.
